Criminal Charges Tossed in Massive Mortgage Fraud Case

Criminal charges are off the table for upstate New York real estate developer Robert Morgan in what prosecutors alleged was a mortgage fraud scheme involving hundreds of millions of dollars. So reports the Rochester, N.Y. Democrat and Chronicle.

U.S. District Judge Elizabeth Wolford has dismissed the indictment against Morgan and his alleged co-conspirators, finding that inadvertent delays in producing electronic evidence had violated the defendants’ right to a speedy trial.

The U.S. Attorney’s Office could still seek a new indictment, but the 81-page decision is a serious hit to what has been a major white-collar investigation.
